Miss Best's Affiliate Program

By signing up to this Affiliate Programme through E-junkie, you acknowledge that you have read this agreement and agree to all its terms and conditions.

By 'you' we mean you, the Affiliate. By 'we' or 'I' we mean Miss Best.


(1.) Unsolicited Email (SPAM)

(1.1) Miss Best prides itself on not participating in sending mass unsolicited email (spam), and all Affiliates are expected to adhere to this policy. Violation of this policy will result in the immediate termination of this contract and immediate dismissal from the Miss Best Affiliate Program.


(2.) Affiliate Membership

(2.1) Membership to the Miss Best Affiliate Program is free of charge.
(2.2) Miss Best reserves the right not to accept any site into the Affiliate Program based on site content.
(2.3) The Miss Best Affiliate Programme is a single tier programme.


(3.) Commissions

(3.1) Affiliates must have applied, and been accepted, to the Affiliate Program and have an active link from their website to their Affiliate link in order to qualify for commissions.
(3.2) Commissions are only available on full-priced items and are not applicable to discounted or sale items or services.
(3.3) Commissions are not available for products/services that you have purchased yourself.
(3.4) Miss Best reserves the right to lower, raise, or discontinue the current affiliate commission percentage. But don't worry, all affiliates will be notified of this by email in advance.
(3.5) Commissions will not be paid for products/services that are later refunded.
(3.6) Commission is paid on the NET order amount i.e. commission is NOT paid on the total amount that includes VAT.


(4.) Payment of Commission


(4.1) All commission is paid to you in either GBP pounds sterling or US Dollars or SEK, and we will send you your commission money by PayPal. You can sign up for a free Paypal account here.
(4.2) Payments will be paid on a monthly basis, once your affiliate commission reaches £ 25 or $40 (USD) or 300 SEK or more.
(4.3) Affiliates with a Swedish bank account are able to receive commission payment in SEK directly to their bank account, by prior agreement with Miss Best. Please contact us for details.
(4.4) If your commission does not reach £ 25/$40/300 SEK for one month, your commission will be rolled over into the next month, and so forth until you reach the qualifying amount for payment.
(4.5) Commission payments are made on or around the 20th day of each month for the previous month's income.


(5.) Orders

(5.1) Miss Best will be solely responsible for processing all orders placed by a customer on the Affiliate Site.
(5.2) You are not authorized to sell any of these products from your site as a "reseller" and no "resale" rights are granted in any way on these products unless otherwise noted.


(6.) Customers

(6.1) Customers who purchase products and services through the Affiliate Program will be deemed to be customers of Miss Best, and Miss Best's policies will apply for these purchases.
(6.2) Miss Best's pricing structure will always determine the price paid by the customer.


(7.) Relationship of Parties

(7.1) This Agreement will NOT create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties.
(7.2) As this agreement does not form any type of employment relationship Miss Best is not responsible for payment of employee benefits, social contributions or any similar payments usually paid by employers.
(7.3) Affiliates are responsible for declaring earned income to their local tax agency.


(8.) Term and Termination

(8.1) The term of this Agreement will begin when you accept and will end when terminated by either party. Either Miss Best or you may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. Upon the termination of this Agreement for any reason, all licenses granted hereunder shall immediately terminate and you will immediately cease use of, and remove from Affiliate's Web Site, all links to the Miss Best site, and all Miss Best trademarks and logos, other Miss Best Marks and all other materials provided in connection with this Agreement.
(8.2) We may reject your application or terminate your membership to the Affiliate Program if we determine (in our sole discretion) that your site is unsuitable for the Program for any reason.


(9.) Limitation of Liability

(9.1) We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to you under to this Agreement.


(10.) Disclaimers

(10.1) We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate links will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.


(11.) Miscellaneous

(11.1) Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
(11.2) If any of the provisions of this Agreement are determined by a court to be unenforceable, they shall be severed from this Agreement, and the remaining provisions shall remain in full force and effect.
